New Delhi, Sep 4 (UNI) The Supreme Court on Wednesday deferred to September 18 the hearing on review petitions pending against a judgment passed in the Vijay Madanlal Choudhary case in which the court upheld provisions of the Prevention of Money Laundering Act (PMLA) that deal with the Enforcement Directorate’s power to arrest, attach assets and search and seize.
A bench comprising Justice Surya Kant and Justice Ujjal Bhuyan, after hearing Senior advocate Kapil Sibal who mentioned the matter in the morning, deferred the hearing to September 18 as the third judge on the bench was not present.
A three-judge bench of Justice Surya Kant, Justice CT Ravikumar and Justice Ujjal Bhuyan is hearing the review petitions. On Wednesday, Justice Ravikumar was not sitting so the matter had to be re-listed.
The Vijay Madanlal Choudhary judgment was delivered by a bench comprising Justice A M Khanwilkar, Justice Dinesh Maheshwari and Justice C T Ravikumar on July 27, 2022 which upheld certain provisions of the Prevention of Money Laundering Act, 2002 (PMLA).
The provisions upheld were – Sections 5, 8(4), 15, 17 and 19 of PMLA, relating to the Enforcement Directorate’s power of arrest, attachment, search and seizure.
After this decision, about 8 review petitions were filed, including that of Karti P Chidambaram, asking the Apex Court to re-look into the judgment.
