SC upholds anticipatory bail in rape case, says women also committed an offence

New Delhi, July 17 (UNI) The Supreme Court on Wednesday upheld the anticipatory bail granted to a man accused of raping a married woman on the false promise of marriage and rebuked the woman for having an extramarital affair.

A bench comprising justices MM Sundresh and N. Kotiswar Singh made these observations while hearing the woman’s plea seeking cancellation of the man’s anticipatory bail.

During the hearing, the woman’s counsel argued that the accused repeatedly called her to hotels for physical relations under the false assurance of marrying her.

The bench, however, questioned her conduct, stating, “You are a married woman with two children. You are a mature person, and you understand the relationship you were building outside your marriage.”

The court further remarked, “Why did you go to hotels repeatedly on his request? You very well understand that you have also committed an offence by having a sexual relationship outside your marriage.”

According to case details, the woman and the accused met in 2016 through social media and developed an intimate relationship. She alleged that under his pressure, she sought divorce from her husband, which was granted by a family court on March 6 this year. However, when she asked the man to marry her after her divorce, he refused, prompting her to lodge a complaint with Bihar Police, accusing him of sexual exploitation under the false promise of marriage.

Earlier, the Patna High Court had granted anticipatory bail to the man, noting that no intimate relations took place after her divorce.
