SC to hear CBI’s challenge to Delhi HC’s bail order in Unnao rape case

New Delhi, Dec 29 (UNI) The Supreme Court on Monday will hear the Central Bureau of Investigation’s (CBI) Special Leave Petition (SLP) against the Delhi High Court order that suspended the sentence and granted bail to former Uttar Pradesh MLA Kuldeep Singh Sengar in the Unnao rape case.

The SLP, titled Central Bureau of Investigation vs. Kuldeep Singh Sengar, was filed on December 26, 2025, challenging the Delhi High Court’s decision dated December 23, 2025, by which Sengar’s life sentence was suspended during the pendency of his appeal.

The matter will be heard today by a vacation bench comprising Chief Justice of India Surya Kant, Justice J.K. Maheshwari, and Justice Augustine George Masih.

Kuldeep Singh Sengar was convicted in December 2019 by a special CBI court for the rape of a minor girl in Unnao district of Uttar Pradesh and was sentenced to life imprisonment, along with a fine of Rs 25 lakh.

Sengar had filed an appeal against his conviction before the Delhi High Court in January 2020 and later moved an application seeking suspension of sentence in March 2022.

The plea for suspension of sentence was strongly opposed by the CBI as well as the victim, through their respective counsel. Despite this, the Delhi High Court, by its order dated December 23, 2025, suspended Sengar’s sentence and granted him bail, subject to certain conditions, pending disposal of his appeal.

However, Sengar continues to remain in jail as he is also serving a 10-year sentence in a separate CBI case relating to the culpable homicide of the victim’s father.

After examining the High Court’s order, the CBI decided to challenge it before the Supreme Court, leading to the filing of the present SLP.
