New Delhi, Jun 16 (UNI) The Supreme Court on Monday declined to entertain the plea of Amtek Group promoter Arvind Dham seeking interim relief in a money laundering case, questioning the maintainability of his fresh application after a previous rejection by a three-judge bench.
A vacation bench comprising Justice Sandeep Mehta and Justice PB Varale expressed strong reservations about the second special leave petition (SLP) being filed during court vacation after the earlier SLP was dismissed.
The bench questioned the propriety of repeatedly approaching the Court on the same issue.
Senior advocate Mukul Rohatgi, appearing for Dham, submitted that the petitioner was merely seeking interim bail.
However, Justice Mehta pointedly asked, “First of all, I don’t understand the appearance of senior counsel during vacations. This court has often commented on that… Before addressing the merits, come to page 239. Are you asking us to review that order?”
The court recalled that a three-judge bench had already dismissed Dham’s earlier plea, and expressed disapproval over the attempt to seek the same relief again before the vacation bench.
Rohatgi submitted that the petitioner had been in custody for over 10 months, and argued that cognisance in the case had been stayed by the High Court at the instance of the other side, making a case for interim bail. However, the bench was not persuaded.
