SC questions plea seeking FIR against Delhi HC judges, appoints amicus curiae

New Delhi, July 17 (UNI) The Supreme Court today expressed strong reservations over a petition seeking the registration of a First Information Report (FIR) against sitting judges of the Delhi High Court for their judicial decisions.

A bench comprising justices Surya Kant and Joymalya Bagchi questioned the maintainability of the plea and asked the petitioner’s counsel under what law judges could be prosecuted for delivering judgments.

“Tell us under which law judges are liable to be prosecuted for giving judgments against you. Just because there are illegal or perverse petitions being filed, you cannot ask for FIRs against judges,” the bench observed.

The petitioner’s counsel submitted that his client was the topper in an examination but was denied relief by various high court judges, prompting his request for criminal action against them.

The plea named sitting judges as respondents, alleging judicial bias.

Finding the petition unclear and legally untenable, the court appointed senior advocate Dr S. Muralidhar as amicus curiae to assist it in the matter.

“We appoint Dr. Muralidhar as amicus. Let the paper book of the plea be provided to him,” the court directed.

The matter will now be examined with the assistance of the amicus before further orders are passed.
