No copyright case against Sujoy Ghosh, rules Supreme Court

New Delhi, Mar 20 (UNI) The Supreme Court on Friday allowed a petition filed by director Sujoy Ghosh seeking to quash a criminal case filed under Section 63 of the Copyright Act, 1957, on the allegation that his movie “Kahaani 2: Durga Rani Singh” was based on a stolen script.

A bench of Justices Pamidighantam Sri Narasimha and Alok Aradhe quashed the criminal proceedings against the national award-winning scriptwriter, which was pending before the Chief Judicial Magistrate, Hazaribagh, Jharkhand.

A complaint was filed before the Chief Judicial Magistrate, Hazaribagh, by Umesh Prasad Mehta, who alleged that the script of Vidya Balan starrer “Kahaani 2”, a sequel to the movie “Kahaani”, infringed the copyright of his script titled “Sabak”.

A trial court in Jharkhand found a prima facie case under Section 63 of the Copyright Act, 1957 and issued summons. The High Court refused to quash the case, saying issues should be tested during the trial.

Ghosh then approached the Supreme Court, which has now overturned those decisions.
