Kolkata, June 14 (UNI) The Calcutta High Court has reversed a lower court order and directed the CBI to include Gorkha leader Bimal Gurung in a chargesheet into the murder of his rival Madan Tamang in Darjeeling Hills in 2010, court sources said Friday.
The Justice Subhendu Samanta’s single bench order came Thursday following a writ filed by Tamang’s widow, Bharati Tamang after the lower court in 2017 had ordered to exclude Gorkha Janmukti Morcha (GJM) then supremo Bimal Gurung’s name from some 46 other accused persons in ABGL president Madan Tamang murder case near Darjeeling Mall in May 2010.
Sources said the High Court “set aside” the lower court’s order to discharge Bimal Gurung from the case related to the 2010 murder of Madan Tamang, then president of Akhil Bharatiya Gorkha League (ABGL).
Bharati and the CBI had approached the high court in 2017 and filed a revision petition against the Calcutta city session court’s order to drop the name of Gurung from the chargesheet.
In a brazen daylight attack Tamang was brutally hacked to death on May 21, 2010, just before he was supposed to address a public meeting.
The CID was primarily investigating the criminal case but after Nicole Tamang, a member of the GJM, and the prime accused, escaped from CID custody, it was handed over to the CBI.
