Delhi Court lists defamation complaint against CM, AAP MP Sanjay Singh on Feb 6

New Delhi, Jan 27 (UNI) A Delhi Court on Monday listed the defamation complaint filed against Chief Minister Atishi Marlena and AAP MP Sanjay Singh on February 6 for miscellaneous arguments on point of taking cognizance.

Additional Chief Judicial Magistrate (ACJM) Paras Dalal after hearing the matter said, ” Both parties are at liberty to explore the possibility of settlement outside the court before NDOH. Matter be fixed for miscellaneous arguments on point of taking cognizance on 06.02.2025 at 10:30 am.”

Sandeep Dikshit filed a fresh complaint u/s 223 BNSS for offence alleged u/s 356 r/w 3(5) BNS against the accused in the court. The allegation in the complaint is that the two proposed accused have made defamatory allegation during their press conference on December 26 last year.

The allegations made by the accused persons against the complainant is that he has colluded with opposition political party to receive crores of rupees and further have election campaign for Delhi Assembly Election 2025 funded by the party.

Counsel for complainant submitted that Complainant belongs to Indian National Congress, the opposition party is Bhartiya Janta Party and the proposed accused persons represent the Aam Aadmi Party. The complainant has alleged that vide the statements of the accused persons, his image has been tarnished and defamed which was published and circulated in the media.

Moreover, the complainant has alleged that proposed accused no.1 has reiterated the allegations through a post on ‘X’ a popular Internet social media channel.

Rajat Bhardwaj, Advocate today filed memo of appearance on behalf of proposed accused no.1 and Vakalatnama filed on behalf of proposed accused no.2 before the court.

Counsel for accused submitted that some pages of the complaint supplied to them are deficit.

After hearing the submission, the court said, ” Ld. counsel for the complainant is directed to supply the copy of complaint with annexures to the opposite side”.

The Counsel for complainant submitted on the last date of hearing that the case invokes Section 356 read with Section 3(5) of the BNS Act, 2023, and includes additional charges under Section 223 and Section 222(1) for summoning and punishing the accused.
