BMW crash ‘wholly Accidental’, says bail plea

New Delhi, Sep 16 (UNI) The bail application filed in connection with the sensational BMW accident case, which resulted in the death of Navjot, a Deputy Director with the Ministry of Finance, states that the incident was “wholly accidental” and not attributable to any intention or negligence on the part of the accused driver.

Senior designated lawyer Vikas Pahwa will represent Gaganpreet Kaur, the woman driving the BMW at the time of the accident.

“The applicant is a law-abiding citizen, mother of two minor children, with deep roots in society and no previous criminal antecedents,” the bail application states. It explains that while passing near Dhaula Kuan Metro Station, Pillar No. 67, the vehicle “in an unforeseen manner, struck the divider and flipped into the air, during which the motorcycle carrying two passengers came into contact with a DTC bus on the left.”

The application notes that the deceased’s motorcycle collided with a DTC bus, resulting in fatal injuries. A passing tempo driver stopped at the scene, and Gaganpreet Kaur and her husband requested him to take them to Nulife Multi Speciality Hospital in GTB Nagar. The tempo driver also transported the motorcycle passengers in the same vehicle.

The bail plea emphasises that “the incident was wholly accidental and in no manner attributable to any intention or negligence on the part of Gaganpreet Kaur. No offence has been committed by her.”

The application highlights her strong community ties, absence of criminal history, and full cooperation with investigators. It argues that custodial interrogation is unnecessary, as the investigation can proceed effectively without her being in custody.

The court is scheduled to hear the matter tomorrow. Delhi Police has added sections under the Bharatiya Nyaya Sanhita (BNS), including Section 105 (culpable homicide not amounting to murder) and Section 238A (destruction of evidence) in the FIR.

According to Delhi Police sources, individuals travelling in the BMW attempted to conceal evidence and withheld information about the incident.

These allegations have been included in the formal charges.

Yesterday, the accused woman driver was remanded to two days of judicial custody.
