The Supreme Court on Thursday refused to refer the question whether a “mosque as a place of prayer is an essential part of Islam” in the Ramjanmabhoomi-Babri Masjid case to a larger bench.
A three-judge bench, headed by Chief Justice Dipak Misra and comprising Justices Ashok Bhushan and S Abdul Nazeer, passed the verdict in a jam-packed courtroom.
Justice Misra and Justice Bhushan delivered the majority judgment, while Justice Nazeer dissented, and said the issue of whether mosques are an integral part of Islam needs to be considered by a larger Constitution bench.
