CJM allows transit remand of IYC activists; FIR against Delhi cops under probe

Shimla, Feb 26 (UNI) A day after a dramatic early-morning operation at a resort in Chirgaon triggered an inter-state police confrontation, 20 members of the Special Crime Branch of Delhi Police and three Youth Congress activists were produced before the Chief Judicial Magistrate (CJM), Shimla, in connection with the FIR registered by Himachal Pradesh Police.

After hearing arguments from both sides, the CJM allowed the transit remand of the three Youth Congress workers, permitting Delhi Police Crime Branch to take them into custody and transport them to Delhi for further investigation.

With the court granting transit remand, the Delhi Police team has now been allowed to proceed with the detained activists, who are accused in the AI Summit protest case.

Officials indicated that the activists are required for further interrogation in relation to allegations of unlawful assembly and obstruction during the summit event.

The FIR, lodged at police station Chirgaon on Wednesday is based on a complaint by Sandeep Ranjan, associated with Chanshal Resort at Mandli. The complainant alleged that around 12-15 unidentified persons in plain clothes arrived at the resort around 5am and forcibly took away three guests staying there.

It was further alleged that the group also removed the guests’ Thar vehicle and seized the DVR of the resort’s CCTV cameras without issuing any written notice, seizure memo, or receipt.

On this basis, a case was registered under various sections of the Bharatiya Nyaya Sanhita (BNS), 2023, relating to alleged wrongful restraint, use of force, and removal of property without due process.

Following the registration of the FIR and subsequent ‘naka-bandi’ at Shoghi and Dharampur, the Delhi Police team and the three detained Youth Congress activists were brought to Shimla and presented before the CJM.

During court proceedings, Delhi Police produced documentation, including seizure memos and related papers, to support the legality of their action. They also submitted a production warrant and sought transit remand of the three Youth Congress activists, who are wanted in an FIR registered in Delhi in connection with protests during the AI Summit 2026.

Meanwhile, the FIR registered by Himachal Pradesh Police against unidentified persons in connection with the Chirgaon resort incident remains under investigation. Sources suggest that Shimla police will examine the documents submitted by Delhi Police, including seizure records and procedural compliance details, before deciding on further action.

Depending on findings, Shimla police may either file a challan (chargesheet) or submit a closure report if procedural compliance is established. The episode marked by a pre-dawn operation on Wednesday, highway interception, and courtroom scrutiny has brought inter-state policing procedures under sharp focus.

The three Indian Youth Congress activists identified as Sidharth, Saurabh and Arbaz had recently been named in the Delhi Police Crime Branch investigation into the AI Summit protest case, and further legal proceedings are expected in the national Capital.
