AAP MP Raghav Chadha raises concerns over Copyright Law in digital age

New Delhi, Dec 18 (UNI): Aam Aadmi Party (AAP) Rajya Sabha member Raghav Chadha raised the issue of copyright strikes on digital content creators in Parliament on Tuesday. The AAP MP called for the modernisation of India’s Copyright Act of 1957, stating it is outdated for the current digital era.

Chadha argued that millions of Indians now rely on platforms like YouTube and Instagram for their livelihood as educators, reviewers, and entertainers. He expressed concern that their channels, built over years, can be taken down in minutes due to opaque, algorithm-driven copyright enforcement.

He emphasised the distinction between piracy and fair use, advocating for legal protection of transformative, incidental, educational, and critical use of copyrighted material. Chadha stated that creativity is stifled when creators operate under constant fear of content removal.

The MP outlined three primary demands: Amending the Copyright Act to clearly define digital fair use, introducing a doctrine of proportionality in enforcement so that penalties match the infringement, and ensuring mandatory due process is followed before any content is removed.
