SC to hear Isha Foundation’s plea to restrain Tamil media outlet from publishing alleged defamatory content

New Delhi, July 16 (UNI) The Supreme Court today agreed to hear a plea filed by Sadhguru’s Isha Foundation seeking to restrain Tamil media outlet Nakkheeran Publications from publishing allegedly defamatory content against it.

The matter was mentioned before a bench of Justice Surya Kant and Justice Joymalya Bagchi by Senior Advocate Mukul Rohatgi, appearing for Isha Foundation.

The bench listed the case for hearing next Monday.

Last year, Isha Foundation had filed a defamation suit against Nakkheeran Publications before the Delhi High Court, claiming that some of its content maligned the foundation’s reputation and sought damages of Rs 3 crore.

In response, Nakkheeran Publications filed a transfer petition before the Supreme Court seeking to shift the defamation case from Delhi to Chennai.

Isha Foundation has now filed an application in the pending transfer petition, seeking to restrain Nakkheeran Publications from continuing to publish any defamatory material against it.

During today’s mention, Rohatgi argued that the Tamil media outlet was persisting with its “vilification campaign” against Isha Foundation while simultaneously seeking the transfer of the case to Chennai.

He informed the court that a chamber judge had issued notice on the transfer plea, but contended that such a plea could not be used to continue publishing defamatory material.

“He can’t have a transfer and carry on this… It is to stop him from carrying on this defamatory campaign, why moving transfer here and stultifying… he must stop if he wants the jurisdiction of this Court to be utilized… we are a charitable organization with disciples all across the world… today, on social media, he’s going on and on…,” Rohatgi submitted.

Taking note of the submissions, the bench posted the matter for hearing on Monday.
