I just remembered the case known as Best Bakery murder case in which the trial held in Gujarat of Zahira Bi and others was set aside and the court directed retrial to be held in other state as the complainant had grievance that he may not get justice in the state of Gujarat. Now, long old pending investigation of Soharabuddin encounter case is concluded and chargesheet has also been filed. It is in the interest of the accused persons that the trial be held in any other state other than state of Gujarat lest there may be retrial after there is a verdict in this case. Let good sense prevail in the mind of complainant party so as to save the time of judicial courts. This is a word of caution to them. In India special courts established for them are trying cases of SC-ST class persons. Thus this system is caste based judicial system. Now, it is just possible that in future there may be a routine system in India for Minorities and OBC persons too so that the cases in which Minority class persons are complainant may be registered and decided by special police establishment and special courts. Like SC-ST Prevention of Atrocities Act and Muslim Women maintenance on Divorce Act. There should also be an Act to be known as Minority and OBC class Persons Prevention of Atrocities Act. Our Constitution speaks of non-secular state but our acts show that rulers believe in caste based system for all except Hindus in general. PV Namjoshi, Ujjain
