Nation Posted On Sunday, March 22, 2009 | Agencies New Delhi, March 22: The Presidential Notification for the first phase of general election covering 124 Parliamentary Constituencies spread across 15 States and two Union Territories will be issued tomorrow. With this, the process of filing nominations will begin. The states that would be covered under the first phase include Arunachal Pradesh (2), Chhattisgarh (11), Kerala (20), Meghalaya (2), Mizoram 1, Nagaland (1), AP (22), Assam (3), Jharkhand (6), Manipur (1), Orissa (10), Maharashtra (13), Bihar (13), Jammu and Kashmir (1) and Uttar Pradesh (16). The two union territories Andaman and Nicobar Islands (1) and Lakshadweep (1) would also go for elections in the same phase. The polling for the first phase would take place on April 16, while the counting of votes for all the phases would be done on May 16. The last date for filing of nominations will be March 30, while the last date for withdrawal of candidature has been fixed as April 2. The scrutiny of nomination papers would be carried out on March 31. The model code of conduct has already come into force from March 2 and now, with the issuance of notification, the ambit of the Election Commission would expand and cover all candidates and political parties for any violation of the MCC for the smooth, fair and free elections. All the candidates would be required to file affidavits along with their nomination papers. The affidavits would include information on the criminal antecedents of the candidates, assets including the movable and immovable proproperties of the candidate, spouse and dependants, liabilities of the candidate and his/her education qualification. The filing of the affidavit would be mandatory and not filing the same would result in the rejection of the nomination papers by the returning officer (RO). Any individual or civil society organisation desirous of obtaining this information could apply in the district election officer with a nominal payment to the copy charges. It is mandatory under election law for every contesting candidate to maintain and furnish accounts of his election expenditure under Section 77 of the Representation of People's Act 1951. Only the expenses on account of travel of leaders of political parties whose names are communicated to the Commission and to the Chief Electoral Officer of the state within the prescribed period of date of notification of seven days would be exempted from being included in the accounts of the expenses of the candidate. All other expenses incurred/ authorised by the political parties, other organisations, body of persons, individuals would be required to be included in the account of the candidates. The Commission has decided to use electronic voting machines (EVMs) in all the polling stations in the country.
