SC allows MP to go ahead with canal construction work

The Supreme Court today allowed Madhya Pradesh government to go ahead with the construction of canal for Indira Sagar and Omkareshwar projects.
The apex court said the state government can continue with the digging, excavation and other works related to the canal subject to the approval of the Command Area Development (CAD) plan submitted by it before the Centre.
A Bench comprising Chief Justice K G Balakrishnan and Justices J M Panchal and B S Chauhan said the expert committee of the Ministry of Environment and Forest (MOEF) will examine the question of environmental measures of CAD plan within six weeks.
The court posted the matter for further hearing on March 25 on various other issues including the aspect of relief and rehabilitation for the project-affected people.
 The order was passed on an appeal filed by the state government against the order of the Madhya Pradesh High Court restraining it from further acquisition of land and carrying out of excavation and canal work for Indira Sagar and Omkareshwar projects.
The High Court had passed the order on a petition filed by Narmada Bachao Andolan activist Medha Patkar. Patkar had submitted that the design and diagramme of the canal was not approved and would invite environmental problem.
However, the Bench said the canal is a subject matter of the state government and MoEF can only go into the environmental aspect of it.
