With the Government remaining non- committal on giving the Leader of the Opposition post to the Congress, party leader and former Parliamentary affairs Minister Kamal Nath today said the Congress should approach the court if it was denied the post.
Talking to a TV channel, Mr Kamal Nath, replying to a question on whether the Congress planned to approach the court if denied the position of LoP, said,’’certainly, we must (approach the court). It should be one of the options.’’ Talking to Headlines Today, Mr Kamal Nath said the decision by Lok Sabha Speaker Sumitra Mahajan on the issue of granting Leader of the opposition Post to the Congress could be ‘flamoured’ by the BJP and Prime Minister Narendra Modi. ‘’We know the Speaker is from the BJP. The Speaker is appointed by a political party. When it is a contentious situation, it will be flavoured by the BJP and Modi’’ he said. Mr Kamal Nath said there is no rule which says that a party cannot get a LoP post unless it has ten per cent of the total strength of the 543 member Lok Sabha.
He said while a Speaker is generally neutral when it comes to dealing with Parliamentary processes, it was different in a contentious situation.
He, however, added that he did not mean that the Speaker is acting on the behest of anybody. ‘’But there is always a flavour,’’ Mr Naidu said.
He said the Congress getting the LoP post was necessary. ‘’The Democracy needs LoP. The sanctity of the Democracy requires that the post be filled and not left empty,’’ Mr Kamal Nath said. The statement by Kamal Nath came even as Union Minister for Parliamentary Affairs Venkaiah Naidu today said a final decision on giving the Leader of the Opposition post to the Congress would be taken by Lok Sabha Speaker Sumitra Mahajan and urged everyone to abide by the decision of the presiding officer. ‘’Let us see how the Speaker decides. There are some conventions, rules and regulations, precedents and directions of the Speaker.
They are all there before us. Everybody has to go by that. Speaker’s decision should be adhered to,’’ Mr Naidu said while addressing an event held at BJP office here on the occasion of Jan Sangh founder Syama Prasad birth anniversary.
