Probe ordered into BEd course notification

Bhopal, May 19: The Governor and Chancellor Dr Balram Jakhar has ordered an enquiry into the disputed notification of March 17, 2008 issued in violation of the directives of the High Court Jabalpur by Barkatulla University, Bhopal regarding admission to the BEd course and affiliation. Retired IAS officer Dharmendra Nath has been appointed the enquiry officer. He has been directed to submit his report within 15 days.

As per the order issued by Raj Bhawan in this regard, terms of reference have been fixed for the enquiry. The enquiry officer would ascertain as to who are the officers responsible for issuance of the disputed notification rejected by the High Court; whether the procedure prescribed for issuing a notification was followed or not; whether the decision to issue the disputed notification was endorsed by the Executive Council or not; on the basis of which interim order and in which writ petition of which date the disputed notification was issued and on which date the final decision was taken.

The enquiry officer would also ascertain as to in which circumstances and on the order of which higher authority was the notification issued. Through the disputed notification colleges were granted affiliation and permission of admission for which BEd courses and when was the list of these colleges issued.

It would also be enquired into as to when and what action was taken by the university administration after cancellation of the disputed notification by the High Court for its being volatile of the law. If any irregularity were found in the enquiry its detail would be given in the report.

The Chancellor has authorised the enquiry officer to lay down the procedure for systematic enquiry into the matter. The university would be able to appoint its representative for hearing during the enquiry. The Registrar of the university has been directed to make available copies of relevant documents and Acts/rules, ordinances/ regulations/ directives etc to the enquiry officer during the enquiry.
