The court of fifth additional sessions judge, Ramkumar Choubey convicting the main accused,Mahendra Singh of Vallabh Bhawan firing case under section 304(2) of CrPC and under section 30 of 308 of Arms Act awarded 10 years rigorous imprisonment.
Whereas, the co accused, Sharad Awasthy and LN Kailasia have been acquitted in this case. Advocate, PC Kothari advocated from this party and Rajendra Giri was advocate from government.
According to prosecution, the incident had taken place on August, 29,2007 near gate number-1, Vallabh Bhawan. On the day of incident , the procession of employees association leader, LN Kailasia was being taken out.
Sharad Awasthy, AN Kailasia were present in the procession and Mahendra Singh had brought a .12 bore without license gun.
A dispute between the accused and present employees took place on any issue.
Mahendra Singh opened fire with his gun, as a result band master, Ramesh Wankhede received serious injuries and died while Sudhakar Baburao Valmiki, Arvind, Narayan and Radheshyam received serious injuries.
A report in this connection was lodged in Jehangirabad police station. Police registering cases under section 308,304(2), 109 and section 30 of Arms Act arrested all the accused and sent jail.
The court on the basis of witness awarded punishment to the accused.
